Parliament adopts reform of the EU electricity market

Il Parlamento europeo ha adottato giovedi 10 aprile la riforma del mercato dell'energia elettrica dell'Ue

EN : The reform adopted on Thursday 11 April will make the EU electricity market more stable, affordable, and sustainable.

The measures, composed of a regulation and a directive already agreed upon with the Council, were adopted with 433 in favour, 140 against and 15 abstentions, and 473 votes to 80, with 27 abstentions, respectively.

The law will protect consumers against volatile prices. 

MEPs ensured that they will have the right to access fixed-price contracts or dynamic price contracts, and receive important information on the options they sign up to. 

Suppliers will not be allowed to unilaterally change the terms of a contract.

 

 

IT : La riforma adottata giovedì 11 aprile in via definitiva mira a rendere il mercato dell'energia elettrica dell'UE più stabile, accessibile e sostenibile.

Le misure legislative - un regolamento e una direttiva - già concordati con il Consiglio, sono state adottate rispettivamente con 433 si, 140 no e 15 astensioni, e con 473 si, 80 no e 27 astensioni. L’obiettivo è proteggere i consumatori dalla volatilità dei prezzi. Durante i negoziati, i deputati hanno inserito misure per dare ai consumatori in tutta l’UE il diritto di accedere a contratti a prezzo fisso o a contratti a prezzi dinamici e ricevere informazioni importanti sulle opzioni a cui si iscrive. I fornitori non potranno modificare unilateralmente i termini di un contratto.

La legislazione prevede i cosiddetti "Contratti per differenza" (in inglese Contracts for Difference, CfD), da stipulare con l’autorità pubblica per sostenere gli investimenti, o schemi equivalenti con gli stessi effetti, per incoraggiare gli investimenti energetici. In un CfD, l'autorità pubblica compensa il produttore di energia se i prezzi di mercato scendono troppo bruscamente, ma incassa una parte dei profitti se i prezzi sono troppo elevati. L'uso di CfD sarà consentito per tutti gli investimenti nella nuova produzione di energia elettrica, sia da fonti rinnovabili che da energia nucleare. 

I deputati hanno inoltre assicurato che i Paesi dell'UE potranno vietare ai fornitori di ridurre l'approvvigionamento di energia elettrica dei clienti vulnerabili, anche durante le controversie tra fornitori e clienti.

 

Le eventuali crisi dei prezzi dell'energia elettrica

 

Il testo crea un meccanismo per dichiarare una crisi dei prezzi dell'energia elettrica. In una situazione di prezzi molto elevati e a determinate condizioni, l'UE può dichiarare una crisi dei prezzi dell'energia elettrica a livello regionale o comunitario, consentendo agli Stati membri di adottare misure temporanee per fissare i prezzi dell'elettricità per le PMI e i consumatori industriali ad alta intensità energetica. 

Sul testo Nicolás González Casares (S&D, ES) ha significativamente dichiarato: “Questa riforma pone i cittadini in prima linea nell'assetto del mercato dell'energia elettrica. Il testo comprende misure volte a proteggere i cittadini, in particolare i più vulnerabili e ad accelerare la diffusione delle fonti energetiche rinnovabili. Il Parlamento ha compiuto un passo avanti nella democratizzazione dell'energia, creando un assetto di mercato che risponda ai fallimenti esposti dalla crisi energetica. Tutti i consumatori, comprese le micro, piccole e medie imprese avranno accesso a prezzi, accessibili, stabili e a lungo termine", 

 

Una risistemazione complessiva in un complicato contesto

 

I prezzi dell'energia sono aumentati dalla metà del 2021, inizialmente nel contesto della ripresa economica post COVID-19. Tuttavia, i prezzi dell'energia sono aumentati notevolmente a causa dei problemi di approvvigionamento di gas a seguito della guerra della Russia contro l'Ucraina nel febbraio 2022. I prezzi elevati del gas hanno avuto un effetto immediato sui prezzi dell'elettricità, in quanto sono collegati tra loro nell'ambito del sistema degli ordini di merito, dove la fonte energetica più costosa (solitamente basata sui combustibili fossili) fissa il prezzo complessivo dell'elettricità.
