EU/ENG - The parliamentary vote of July 9, 2026, marks the definitive completion of a critical milestone in the evolution of payment architectures within the Eurozone. The adoption of the regulatory framework by the European Parliament, secured by 416 votes in favor, establishes the necessary lex specialis to authorize the European Central Bank (ECB) to proceed with the technical implementation phase of the digital euro (DE).

Legal Nature and Mandate

From a technical standpoint, the legislation delineates a fundamental distinction between Central Bank Digital Currency (CBDC) and private commercial money (bank deposits). The digital euro is legally structured as a direct liability of the ECB, thereby cementing its status as the ultimate risk-free asset. This characterization, effectively mirroring physical cash, serves as the cornerstone for mitigating counterparty risk inherent in private sector deposits, confirming the DE’s status as legal tender.

Balancing Innovation and Financial Stability

The approved text addresses two systemic constraints that have dominated the technical discourse throughout the legislative process:

Holding Limits: To preempt the risk of "bank disintermediation"—namely, a structural migration of liquidity from commercial bank accounts to ECB-held wallets, which could constrain the credit-creation capacity of the banking sector—the regulation mandates rigorous per-user holding caps.

Operational Model: The framework expressly rejects total disintermediation. The ECB will delegate interface services to Payment Service Providers (PSPs), ensuring that the digital euro integrates seamlessly into existing infrastructure without disrupting the established business models of commercial banks, all while preserving the neutrality of the underlying settlement layer.

Privacy and Interoperability

The regulation enshrines the principle of privacy by design for low-value transactions, enabling offline payments with a degree of confidentiality commensurate with physical cash, strictly adhering to the European Union’s General Data Protection Regulation (GDPR) standards. The technical challenge will reside in cross-system interoperability; the DE must be natively compatible with legacy payment protocols to minimize friction during the transition from existing frameworks to a CBDC-enabled ecosystem.

Critical Considerations

While the regulatory foundation is robust, the efficacy of the initiative remains contingent upon the technical design's execution. The necessity to reconcile, simultaneously, the anonymity of low-value transactions with Anti-Money Laundering (AML) compliance for larger sums constitutes the most complex technical trade-off of the project.

The transition to the Council of the European Union marks the phase of technical-political refinement. The challenge, leading toward the 2029 target, will be to ensure that the digital euro evolves into a functional, high-throughput infrastructure capable of maintaining systemic resilience against cyber-adversaries.

EU/ITA - Il voto del 9 luglio 2026 segna il superamento di una fase cruciale per l’architettura dei pagamenti nell'area euro. L’approvazione del regolamento da parte del Parlamento europeo, con 416 voti favorevoli, definisce il perimetro giuridico necessario affinché la Banca Centrale Europea (BCE) possa procedere alla fase di implementazione tecnica dell’euro digitale (DE).

La natura giuridica e il mandato

Dal punto di vista tecnico, il legislatore ha sancito la distinzione fondamentale tra moneta digitale di banca centrale (CBDC) e moneta commerciale (depositi bancari). L’euro digitale è configurato come una passività diretta della BCE, garantendone la natura di risk-free asset per eccellenza. Questa qualifica, parificata al contante, è il pilastro che previene il rischio di controparte associato ai depositi privati, conferendo al DE lo status di corso legale.

Bilanciamento tra innovazione e stabilità finanziaria

Il testo approvato affronta due criticità strutturali che sono state al centro del dibattito tecnico durante l'iter legislativo:

Limiti di detenzione (Holding Limits): Per scongiurare il rischio di "disintermediazione bancaria" — ovvero il massiccio deflusso di liquidità dai conti correnti verso i wallet della BCE, che potrebbe erodere la capacità di prestito delle banche commerciali — il regolamento introduce vincoli stringenti sui massimali di detenzione per utente.

Modello operativo: Il framework rigetta la disintermediazione totale. La BCE deleggerà il servizio di interfaccia ai Payment Service Providers (PSP), garantendo che l'euro digitale si integri nell'infrastruttura esistente senza distruggere il modello di business delle banche commerciali, pur garantendo la neutralità dell'infrastruttura di regolamento.

Privacy e interoperabilità

Il regolamento introduce il principio del privacy by design per le transazioni di basso valore, permettendo pagamenti offline con un livello di riservatezza paragonabile al contante, in conformità con i rigidi standard dell'UE in materia di protezione dei dati (GDPR). La sfida tecnica risiederà nell’interoperabilità dei sistemi: il DE dovrà essere nativamente compatibile con i protocolli dei circuiti di pagamento esistenti, riducendo le frizioni nel passaggio dal mondo legacy a quello delle CBDC.

Considerazioni critiche

Sebbene il quadro normativo sia solido, il successo dell’iniziativa dipenderà dall’efficacia del design tecnologico. La necessità di garantire, contemporaneamente, l'anonimato delle transazioni di piccola entità e la conformità alle normative antiriciclaggio (AML) per quelle superiori rappresenta il trade-off tecnico più complesso.

Il passaggio della palla al Consiglio dell'Unione Europea rappresenta la fase di raffinamento politico-tecnico. La sfida, da qui al 2029, sarà quella di garantire che l'euro digitale non rimanga un esercizio accademico, ma diventi un'infrastruttura operativa capace di gestire volumi elevati, garantendo al contempo la resilienza informatica necessaria a contrastare rischi cyber sistemici.
